The European Court gave a preliminary ruling on the interpretation of Articles 3 and 5 of Directive 2009/103/EC in relation to insurance against civil liability for the use of motor vehicles. The conditions needed to satisfy a ‘vehicle’ covered any motor vehicle intended for travel on land and propelled by mechanical power had been met. The concept of the ‘use of vehicle’ was also considered and the European Court concluded that the onus was on the national court to interpret its use with respect to insurance against civil liability for motor vehicles.
