Case O (Human Fertilisation and Embryology Act 2008) [2016] EWHC 2273 (Fam) (13 September 2016)

The Court revoked an Adoption Order made by the court in respect of a child of same-sex parents. The parents had been informed that as a result of clinic errors in paperwork that one of the partners was not a legal parent of the child. They had been previously advised that adoption was the only legal route to secure the child’s legal status so had sought and been granted an Adoption Order. In fact this advice had not been correct and a declaration of parentage could have been pursued but this was not widely known at that time. The declaration was now made and the parents were returned a copy of the child’s original birth certificate with both parents names on it which the Judge made available from the Adoption file.
