Harb v HRH Prince Abdul Aziz Bin Fahd Bin Abdul Aziz [2016] EWCA Civ 556

The CA allowed an appeal made by Prince Abdul Aziz Bin Fahd Abdul Aziz against an order that he make payments of £12 million to Mrs Harb and transfer the title of two properties in Chelsea. The court held that the Judge had not dealt fully with the evidence and had asked the wrong question in respect of the issue of agency. The court also considered the letter written by the Judge Peter Smith J but rejected the ground of appeal of apparent bias. The matter will be listed for re-hearing.
