Ciccone v Ritchie [2016] EWHC 616 (Fam)

The court’s permission was required for the withdrawal of applications under the Hague Convention on the Civil Aspects of International Child Abduction 1980. When considering whether permission should be given, the court would be guided by the overriding objective in the Family Procedure Rules 2010 r.1.1. AS to whether the whether the instant judgment and an earlier judgment given in the proceedings should be published, the proportionate approach was to permit the publication of the two judgments without anonymisation, subject to the redaction of certain sensitive matters. That decision was based on the highly specific, and indeed quite exceptional, facts of the case, particularly the extraordinary amount of information that was already in the public domain
