British Gas had failed to make out the defence of experimental use in s.60(5)(b) of the Patents Act 1977; however Meter-Tech’s patent concerning a pre-payment utility metering system lacked inventive step when viewed in the light of the prior art together with the common general knowledge, and fell to be revoked. The court took the opportunity to reiterate the principles governing the availability of the experimental use defence.
