An appeal was dismissed, upholding a decision that the English court had jurisdiction to determine an action concerning the infringement and validity of UK patents (which were claimed to be standard essential patents) and FRAND terms for their licensing. England was clearly the most appropriate forum for resolution of the dispute. The English court could decide the global FRAND royalty, which would include the royalty for China, without precluding the Chinese court from deciding on the validity and essentiality of the Chinese patents.
