Intellectual Property Law: Correction: Fage UK Ltd & Anr v Chobani UK Ltd & Anr, Ch Div (Briggs J), 1/11/12

In the last issue of Law Brief Update, the case summary stated that an interim injunction had been granted in this case to restrain the claimants’ use of the term “Greek yoghurt”. This was incorrect. In fact, the defendants gave temporary undertakings to the Court that that they would not advertise or offer for sale or sell in the United Kingdom yoghurt described as “Greek yoghurt” which has not been made in Greece, pending trial or further Order of the Court. Furthermore, the claimants were required to provide security of £400,000 to preserve it from their unsecured creditors and this was paid into court.
